代位父母（拉丁语：in loco parentis），为术语，指某人或某组织在法律上承担父母职能与责任的情况。该术语起源于英国的英美法系，当中将组织与个人的代位父母情况做区隔。

首先，代位父母允许大学以下学校等机构，能依照他们认为适合于学生的最佳利益与规范行事，但不允许危害学生的公民自由。

其次，如果社会剥夺孩子之亲生父母的教导权，代位父母学说可给予非亲生父母教养孩子的权利与义务。

代位父母学说可分为国家亲权责任、心理亲权与收养三种学说。
