无害通过（innocent passage），国际法专有名词，指他国船舶通过地主国领海之权。在联合国海洋法公约中有专门规范。

具体而言，外国船只依照海洋法公约，有权在某国领海进行无害通过。无害通过系指不损害沿海国的和平、安全和良好秩序的通过。反面而言，只要外国船舶于经过领海时，有损害沿海国和平、良好秩序和安全之情事发生，即为非无害。而当中所谓「通过」，是指为横渡领海但不进入内水、或为驶入内水或自内水驶往公海而通过领海。这种航行应继续不停地迅速进行。非经许可不得停泊和下锚。但通常航行所附带发生的停泊和下锚，或者因不可抗力或遇难目的的停泊和下锚，则是容许的。
